Title Data, Inc. and its subsidiaries (“Title Data”) requires that all visitors (“Users”) to the Customer Portal portion of our site on the World Wide Web (the “Site”) adhere to the following terms and conditions. By accessing the Customer Portal portion of our Site, you confirm your agreement to and acceptance of these terms and conditions.
Laws and Regulations
User access to and use of the Site is subject to all international, federal, state, and local laws and regulations.
Copyright / Trade Secrets
All information and content including any software programs available on or through the Site (“Content”) is protected by copyright and trade secret laws. Users are prohibited from copying, distributing, transmitting, displaying, or otherwise using any Content available on or through the Site except as specifically authorized by the contractual agreement between Title Data, User, and/or User's employer.
No Warranties
All Content on the Site is provided to User “AS IS” without warranty of any kind either express or implied including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security, or accuracy.
Limitation of Liability
User agrees that Title Data and any of its officers, directors, employees, or agents will not be liable whether in contract, tort, strict liability, or otherwise, for any indirect, punitive, special, consequential, incidental, or indirect damages (including without limitation lost profits, cost of procuring substitute service, or lost opportunity) arising out of or in connection with the use of the Site.
Linked Internet Sites
Title Data prohibits caching, unauthorized hypertext links to the Site, and the framing of any Content available through the Site. Title Data reserves the right to disable any unauthorized links or frames and specifically disclaims any responsibility for the content available on any other Internet sites linked to the Site. Access to any other Internet sites linked to the Site is at User's own risk.
Access to User's Workstation
Title Data makes available to Users, from the Customer Portal portion of our Site, a feature called Remote Support, which permits us to remotely and temporarily access a User's workstation by means of the Internet. This feature can only be activated when a User selects the Remote Support option, and it is only used by Title Data to assist a User with access to and use of our products and services. User acknowledges and agrees that Title Data is authorized to remotely access User's workstation, for the purposes set forth above, whenever User selects the Remote Support option.
Changes to Terms and Conditions
Title Data reserves the right to revise these terms and conditions at any time, and Users are deemed to be apprised of and bound by any changes to these terms and conditions.
Violations of Terms and Conditions
Title Data reserves the right to seek all remedies available at law and in equity for violations of these terms and conditions, including the right to block access from a particular Internet address to the Site.
Access to the Site
Access and use of the Site is restricted to authorized Users only. Unauthorized individuals attempting to access the Site may be subject to prosecution.
Jurisdiction / Governing Law
Users of this Site agree to submit to the laws of the State of Texas, USA, and applicable federal law without regard to conflicts of laws principles.
